PSI Exclusive arrangement studies launched!
The European Commission has announced that contracts have been to undertake studies to assess the existence of exclusive arrangements within the context of the Directive 2003/98/EC.
The announcement states that the first set of Member States to be assessed includes:
- Austria
- Belgium
- Czech Republic
- Denmark
- France
- Germany
- Italy
- Poland
- Spain
The announcement calls upon all PSI stakeholders to participate in the studies by alerting the organisations undertaking the studies and states:
“Should you believe of the possible existence of exclusive agreements in a European Country please provide the relevant economic operator with the relevant information.”

To support the studies a descriptive document has also been titled: Exclusive arrangements for the re-use of public sector information. The document states in the opening paragraph:
“The Directive 2003/98/EC on the re-use of public sector information provides that the re-use of information contained in publicly available documents shall be open to all potential actors in the market, even if one or more market players already exploit added-value products based on this information. The necessary corollary to such obligation of overall openness is the prohibition that public sector bodies grant exclusive rights in their contracts /arrangements with third parties (Article 10.1). Moreover, existing exclusive arrangements had to be terminated at the end of the contract or in any case not later than 31 December 2008.”
