Poland outlines new PSI law!

The Polish Ministry of Internal Affairs and Administration published on the 24th September 2009 a consultation document (18 pages) titled: Założenia do projektu ustawy o ponownym wykorzystaniu informacji publicznej (Assumptions for the draft law on re-use of public information).

The document is structured into two parts:

  • Part 1 An introduction; and
  • Part 2 Proposals for decisions and their justification.

Section 3 of the Introduction states:

The purpose of the bill is to implement Directive 2003/98/EC, in particular to establish the rules for re-use of public information in social and economic. Enact laws fill a legal gap in this area. Prepare the ground Legal secondary use of information resources entities performing tasks public. This will improve the competitiveness of companies whose products and services are based on public sector information.

That the title of the proposed new law will be: “ustawa o ponownym wykorzystaniu informacji publicznej” ("Law on the reuse of information interest ").

The draft law should be composed of three components (structured Chapters):

  • Policy issues (and the personal scope, exclusions, definitions);
  • The principles of re-use of information; and
  • Procedural issues related to the mode of transmission of information concerning the application as re-use.

Section 4 of the Introduction states that the proposal is to enact a separate law as 15 of the 27 Member States have done – referencing the European Commission Public Sector Information portal.

The announcement of the consultation document states:

The Polish Ministry of Internal Affairs and Administration published a press release titled: Spotkanie - "Nowe spojrzenie na BIP” (Meeting - "A new look at BIP")

The press release announces that:

On the 3rd September 2009 a meeting took place at the Ministry of Interior Department of the Information Society to consider the issue of the functioning of the Public Information Bulletin. The purpose of the meeting was to gather and discuss comments on the legislation governing access to public information in order to further develop this access, particularly through the Public Information Bulletin.

The meeting led Ministry of Interior, Director, Department of Information Dr Wojciech R. Wiewiórowski and Mrs. Isabella Lennon Centre of Information Ministry of Interior Projects. The Director of Information Society Department of Interior and Administration Mr Vladimir Marciński also attended the meeting.

In addition, interested parties were present Public Information Bulletin government representatives, local government, control authorities, NGOs and representatives of private companies.

The meeting commenced with a presentation by Mr. Director Wiewiórowskiego that provided information on the ongoing work to regulate the reuse of public sector information and the need for the revision of the definition of public information in order to comply with the European Commission's Directive 2003/98 on the re-use of public information.

The meeting then discussed the public information, which raised, inter alia, the following issues:

  • Need to change the definition of public information;
  • Form, form, consolidate public information;
  • Form posting public information;
  • Sharing public information (date and time available).

In addition, the meeting raised the following issues concerning the BIP:

  • Function of the Public Information Bulletin - news and interactive;
  • Appearance and unify the parties subjective BIP;
  • Codification page addresses symptoms of BIP;
  • The menu page of the BIP;

It was jointly agreed that, in this regard it was necessary for close cooperation between the Ministry of Interior as the body responsible for carrying out Party Central Public Information Bulletin and other actors to engage the parties symptoms such as BIP through further consultation.

At the end of the meeting all present were encouraged to continue to participate in public consultation through the portal interoperability and place there of their observations, comments and suggestions on the themes, the Public Information Bulletin.
