Mobile info service forced to close
The decision of the Thessalonki Urban Transport Organisation not to permit re-use of the real time bus arrival information has forced the mobile information service www.staseis.gr to terminate the service. The decision of the transport operator has sparked debate within Greece as to whether the Thessalonki Urban Transport Organisation and the Greek Government are complying with the European Union Directive 2003/98/EC and the national transposition within Greece law number 3448/2006.
The home page of the staseis web site states:

The press release that states:
“Τα δρομολόγια των λεωφορείων δεν αποτελούν “πνευματική ιδιοκτησία” του ΟΑΣΘ
Όπως έγινε γνωστό, ο Οργανισμός Αστικών Συγκοινωνιών Θεσσαλονίκης σε αίτημά μας για χρήση δημόσιων δεδομένων της ιστοσελίδας oasth.gr για την εφαρμογή staseis.gr απάντησε αναφερόμενος στην “ιδιοκτησία” του επί των εν λόγω πληροφοριών. Ο ΟΑΣΘ θεωρεί λοιπόν “πνευματική ιδιοκτησία” τις πληροφορίες για την άφιξη των λεωφορείων και επιχειρεί να απαγορεύσει την ανάπτυξη μιας δωρεάν υπηρεσίας πρόσβασης στις πληροφορίες μέσω κινητού τηλεφώνου.
Η στάση αυτή καταδεικνύει την αδυναμία ενός οργανισμού κοινής ωφέλειας να ενταχθεί στην εποχή της Κοινωνίας της Πληροφορίας. Έχουν ήδη παρέλθει 3 χρόνια από τη θέσπιση του Ν.3448/2006 και 7 χρόνια από την θέσπιση της Οδηγίας της ΕΕ 2003/98 για τα δικαιώματα του πολίτη προς περαιτέρω χρήση (εμπορική ή μη) των πληροφοριών του δημόσιου τομέα.
Ζητάμε από τον ΟΑΣΘ να ενημερωθεί για το σχετικό θεσμικό πλαίσιο, καταθέτοντας την σχετική διοικητική προσφυγή που επιβάλλει την επανεξέταση του αιτήματός μας. Παράλληλα, προσφεύγουμε στον Συνήγορο του Πολίτη, ζητώντας την παρέμβασή του, ώστε να εφαρμοστεί και στην Ελλάδα το ευρωπαϊκό δίκαιο για την περαιτέρω χρήση πληροφοριών του δημόσιου τομέα. Τη νομική υποστήριξή μας έχει αναλάβει ο Βασίλης Σωτηρόπουλος (site, blog).”

This attitude demonstrates the failure of a Utility to enter the era of the Information Society. Have passed 3 years since the adoption of N.3448/2006 and 7 years after the adoption of EU Directive 2003/98 on the rights of citizenship to re-use (commercial or otherwise) of public sector information. We ask the OASTH be informed of the relevant legal framework, by depositing the relevant administrative action requires a review of our request. In addition, resort to the Ombudsman, requesting his intervention to be applied in Greece and European law on the reuse of public sector information. Our legal support has taken Vasilis Sotiropoulos (site, blog)."
