INSPIRE report deadline missed?
The INSPIRE Directive 2007/2/EC came into force in all European Union Member States on the 15th May 2009. One year later the European Commission EUR Lex Access to European law database shows that no information exists from seven Member States namely: Cyprus, Greece, Ireland, Luxembourg, Poland, Spain and Sweden. The EUR-Lex database entry for the transposition of Directive 2007/2/EC states that: The fact that there is a reference to national execution measures does not necessarily mean that these measures are either comprehensive or in conformity.
The INSPIRE Directive 2007/2/EC is closely related to the Public Sector Information Re-use Directive 2003/98/EC for example Catalogues, licenses, access conditions, transparency to name but a few.
Member State reporting
The INSPIRE Directive 2007/2/EC on establishing an Infrastructure for Spatial Information in the European Community places a mandatory responsibility on Member States to report and make public (Transparent) the progress on implementing the INSPIRE Directive. The first report was due at the latest by the 15th May 2010. At the current time it appears that European Member states have not met this obligation or if they have neither the Member State nor the European Commission (Reference: EC-JRC Monitoring and Reporting ) has met the obligation to be transparent so that the stakeholder community can undertake scrutiny of the process.
The Directive states:
“FINAL PROVISIONS
Article 21
1. Member States shall monitor the implementation and use of their infrastructures for spatial information. They shall make the results of this monitoring accessible to the Commission and to the public on a permanent basis.
2. No later than 15 May 2010 Member States shall send to the Commission a report including summary descriptions of:
(a) how public sector providers and users of spatial data sets and services and intermediary bodies are coordinated, and of the relationship with the third parties and of the organisation of quality assurance;
(b) the contribution made by public authorities or third parties to the functioning and coordination of the infrastructure for spatial information;
(c) information on the use of the infrastructure for spatial information;
(d) data-sharing agreements between public authorities;
(e) the costs and benefits of implementing this Directive.
3. Every three years, and starting no later than 15 May 2013, Member States shall send to the Commission a report providing updated information in relation to the items referred to in paragraph 2.
4. Detailed rules for the implementation of this Article shall be adopted in accordance with the regulatory procedure referred to in Article 22(2).”
