INSPIRE: 5 Member States referred to Court!
EC refers Cyprus, Finland, France, Greece, and Luxembourg to the European Court

The European Commission Secretariat-General has published the recent Commission Decisions regarding the Application of Community law on the 3rd June 2010. The report shows that the European Commission scrutiny of the transposition of the INSPIRE Directive 2007/2/EC by Member States continues. The INSPIRE Directive came into force in all European Union Member States on the 15th May 2009.
With respect to the INSPIRE Directive the European Commission has opened 23 cases with Member States of which 15 are still open and 8 have been closed and 5 of the 15 have been referred to the European Court.
During the roundtable Social Value of PSI within the European Public Sector Information Platform – APORTA meeting titled: Realising the Value of Public Sector Information that was held in Madrid on the 9th June 2010 panel member Ms. Claire Gallon of LiberTIC France made reference to the fact that France had been referred to the European Court regarding the INSPIRE Directive.

PSI Directive Relevance
The INSPIRE Directive complements the PSI Directive in a number of areas within the geographic information sector. How a Member State transposes and implements the INSPIRE Directive can also have competition consequences if the body that oversees and manages the implementation is a public sector information holder that operates on the open market and as such competes with other data providers including data and service providers that incorporate the re-use of public sector information.
