The European Commission has published a prior information notice about the future call for a tender (in the Supplement to the Official Journal of the European Union, 2009/S 41-058800) (pdf file page 9/20):

“Study for assessing the existence of exclusive agreements concluded by public sector bodies with certain EU Member States in the context of the Directive 003/98/EC on the re-use of public sector information (PSI Directive).”

The notice states:

“The PSI Directive prohibited exclusive arrangements and set a transitional period (up to 31.12.2008) for exclusive arrangements concluded before the Directive. The purpose of this study is to investigate the existence of such arrangements in the Member States, particularly in those sectors where such practices have traditionally taken place. “
