“The Executive Summary of the report titled: PSI: Identification of potential Exclusive Agreement – Czech Republic. Summary Country report states:
This Final Summary Country Report provides a detailed overview of the activities carried out and the results of the study of the potential existence of exclusive agreements (EA) between Czech public sector bodies (PSBs) and Public Sector Information (PSI) re-users in the context of the PSI Directive.
The research has been carried out between 14th December 2009 and 17th March 2010. It included 26 central PSBs (mainly ministries and their directorates and information agencies) and 46 re-users within the most important PSI Domains in the Czech market (business, geographic, legal, meteorological, social statistical and transport information).
The validation process has resulted in the identification of two potential Exclusive Agreements, which were subject to the legal assessment of an expert from the Faculty of Law, Masaryk University, Brno. A preliminary legal assessment suggests that both of the identified potential EAs may be possibly of an exclusive nature, and therefore void in terms of Article 11 of the Directive 2003/98/EC on the re-use of public sector information (PSI Directive). The first identified EA was found in the Transport information domain, the second one in the Business information domain.
The general opinion of the consulted PSI re-users leads to the conclusions, that in all likelihood, there are no other existing EAs in the Czech Republic and that this issue is not the biggest barrier to a transparent PSI market. Vice versa, obtaining PSI and the completeness and quality of the raw data is considered to be a barrier to the Czech PSI market development.”
