APPSI surprised!
The UK Advisory Panel on Public Sector information (APPSI) has published its response to the UK Department of Communities and Local Government (DCLG) consultation on Local Authorities (Charges for Property Searches) (England) Regulations. The APPSI response states:
“Firstly, APPSI were surprised to note that neither this consultation, nor the earlier one, nor the draft Regulations on property search charges refer specifically to the Re-use of Public Sector Information Regulations (and the supporting), guidance (that is) available. This legislation appears to be relevant as property records fall within the definition of ‘public sector information’. Regulation 15 of these Regulations, in particular, sets parameters on the charges that can be made where public sector information is supplied for re-use.
Secondly, we note that although the draft Regulations on property search charges appear to comply in theory with the Re-use Regulations, we would nevertheless strongly suggest that you consult the Director of OPSI and her team about how best to clarify the relationship between the draft Regulations on property search charges and the Re-use Regulations.”
